I'm trying to imagine what sort of evidence could possibly be collected to show 8647 is a message a reasonable person would understand as a real threat. Even if they found a manifesto where Comey explains his dastardly plan to assassinate the president and do unspeakable things to his body, a reasonable person seeing the post on Instagram still wouldn't know any of that and therefore see 8647 as pretty harmless. Maybe if DOJ had evidence that Comey had a network of likeminded assassins who all understood 8647 as a call to action to execute on long-laid plans, that could justify a credible threat charge. But, it would probably also justify other, more serious charges that are not in the indictment, so I don't think that's what they got. It seems much more likely that they've got nothing and Blanche is blowing smoke to make this indictment less embarrassing until later.

The bigger question is how they got a grand jury to indict at all. The last indictment was thrown out because the prosecutor was illegally appointed, but not before a federal judge also found documented grand jury misconduct so severe he took the extraordinary step of unsealing the proceedings. Nothing suggests this time is different.

The truly amazing thing is how many times a grand jury hasn't been able to indict for this justice department. But the conventional wisdom is the government can always get an indictment. Prior to the current Trump admin, federal grand juries indicted 99.99% percent of the time.
