A Republican-appointed Virginia judge has struck down the Democratic-backed redistricting amendment in full, ruling it unconstitutional and “void from the start.” All votes from the April 21 special election are now invalid, and the state is permanently blocked from using or implementing the new maps. AG Jay Jones says he will immediately file an appeal.
That same judge tried to twice stop the vote before it took place and got beat down both times by the VA Supreme Court. Again, Texas Repubs pushed through redistricting all by themselves and behind closed doors while California and Virginia went to the voters. This will vote will stand.

And then I was querying AI a bunch about it too. His ruling says that a constitutional amendment in Virginia requires a bunch of hurdles to be crossed. It has to pass two separately elected General Assemblies and be posted by the Clerk 90 days before the next general election to be valid. The second passage happened Jan 16, 96 days before the April 21 referendum. But, the first passage was October 31, just 5 days before the general election on Nov 4. So, Hurley ruled that the required 90 days before a general election was not met for the first passage. However, the 90-day requirement does not apply to the Nov 4 general election of the General Assembly. It gets very weedy in Hurley's decision with the legalese, but he is essentially saying that voters didn't get a "meaningful" opportunity to consider the implications re the referendum when they elected their representatives in November. The VA Supreme Court had allowed the referendum to go forward but has not yet ruled on Hurley's finding that the statutory requirements for a referendum were not met. Given Hurley's rather derivative reading of VA law to reach his conclusion, and given that (1) the VA SC leans democrat, (2) they already allowed the referendum to go forward, and (3) backtracking now means taking the cookie away from the new governor and a majority of the voters -- I have to think it's pretty unlikely that the VA Supreme Court will agree with him.
