Is the defense claiming that Anthony had reason to believe his life was in danger? From what I read of the incident, he got shoved and maybe felt threatened because there were a bunch of other kids from the other school. That really isn’t much to cause to resort to deadly force, IMO. Does it rise to murder? I don’t know. But it certainly seems like he committed a criminal act and should face jail time, and I think we agree there.
I think it’s unlikely that he went in wanting to stab someone. I think he reacted very poorly to an escalating situation, stupidly decided to “stand his ground” and use lethal force rather than just leave, and a kid is dead as a result. I’m not clear on the manslaughter vs murder split, but this looks like an entirely avoidable situation right up to the point that he took the knife out of his bag and made a choice to stab a kid in the chest.
Yes being up close in a tent on the opposing sideline can be construed as provocation imo, why is he therre?. That being said I don't know exactly how Metcalf responded but but Anthony immediately stabs him. He is on the opposing sideline, an altercation ensues and he pulls out a knife and stabs Metcalf in the chest Yes I would totally understand the jury concluding he tried to provoke someone,
Manslaughter is basically acting reckless. Murder requires forethought and intent. It's very hard to prove intent. It's not nearly as difficult to prove recklessness. Depending on the perceived threat, you could absolutely argue brandishing that knife was reckless.
Based on the testimony I have heard, no one should think his being in that tent was seeking or manifesting a physical fight.
Arguments happen at high school sporting events all the time, fights happen all the time, when this thread was started I thought it was a stupid disagreement but regardless of how it started there doesn't seem to anything to warrant stabbing another person with intent to kill and stabbing someone in the chest sure seems like intending fatal injuries so you have to question why this began in the first place He stabbed him in the chest. Imo your analysis should start from there
I suppose past history would need to also factor in. Did he have history of violence or evidence that he was seeking to hurt people? Absent that, I agree that this sounds more like a situation of extreme recklessness than intentional murder.
