Alright, you made me go read deeper on the case. I won't give you any crap about not believing the allegation. I do believe the allegation and it doesn't sound outlandish to me, but it is a he-said-she-said thing, so you can disbelieve it. I'd point out we have a court system that had a jury that did believe it, and it's only their opinion that is of any legal consequence. Maybe if 'believe women' doesn't jibe, 'believe juries'? The perjury charge is from a question of whether the lawsuit had outside funding and she said no when in fact there was a nonprofit that helped fund it. It was already the basis for an appeal of the verdict and the appeal had failed with the judge finding that when she was asked the question she was not demonstrably aware of the outside funding. And it was later remedied when the court learned of the outside funding and allowed Trump's lawyers to depose her again. So it seems specious and politically-motivated to bring perjury as an indictment when the allegation was already tested in court and failed. In fact, I think the standard of proof for a criminal indictment is going to be higher than what they would have had to achieve (and yet failed to achieve) in their appeal. So yeah, being a rape victim doesn't mean perjury is okay. But, neither is malicious prosecution. It's far from a slam dunk case that she did perjure herself. What's more, it's not clear it had any material impact on the jury deliberations, which is another element you'd have to prove for a perjury charge. It seems so unlikely that they could win a prosecution that it'd be unprofessional to bring it. And, we're numb to it now, but DOJ isn't supposed to talk about investigations and potentially tarnish reputations before bringing an indictment. They leaked this. I think they leaked it to make Carroll afraid and to send a message to everyone else that anyone who crosses Trump risks going to prison for it. Believe whatever about the sexual assault. If she made it all up and bamboozled a jury to get a multi-million dollar payout, the DOJ leaking stories about bringing shaky criminal charges against her because Trump couldn't win in civil court is still an abuse of their office.

This, in itself, is pretty irrelevant. A quick search shows it’s an upscale store (not Macy’s) in a private fitting rooms. The alleged encounter was brief and sudden. More importantly, the defense already made the argument that the setting makes the story unlikely. The jury still found the overall account more credible after hearing all the evidence from both sides. Focusing on whether something like that could plausibly happen in that location does a lot of the work here, but it’s only one factor. Civil juries aren’t deciding what feels most likely in isolation. They’re deciding whether the full account, taken together with the testimony and context presented, is more likely than not. We didn’t see the full body of evidence or hear all the arguments, so our conclusions are inherently less reliable than the jury’s verdict.

No witnesses. The rules of evidence simply did not apply here -- it was a political hit. Funded by Epstein's dirtiest pal -- Reid Hoffman. And the entire story tracked a Law & Order plot -- Carroll was a big Law & Order fan. Anyone can see this was a staged lie. What stuns me is how willing Democrats are to lie, and then carry forward those lies for YEARS.
